The level of requirement varies by business size, societal function and its level. Make sure to discuss this with a compliance officer to ensure you are meeting your minimum requirement.

1. Eligibility: The Quest KACE Annual Feedback Survey Giveaway Sweepstakes (“Sweepstakes”) is open only to legal residents of the 50 United States and the District of Columbia who are at least 18 years of age at the time of entry. Employees of Quest Software Inc. (“Sponsor”) and its parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Employees of the City of New York are not eligible. Government employees including all federal, state, county, city or municipal government employees, state funded universities and colleges, all types of public officials including elected officials, private individual or firms where the government has outsourced government functions, and K-12 employees are not eligible. All applicable federal, state, and local laws and regulations apply. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. Void where prohibited.

3. Timing: The Sweepstakes begins at 9:00 AM ET on December 6, 2021] and ends at noon ET on December 17, 2021 (the "Entry Period").
4. How to Enter: During the Entry Period, visit the Sponsor’s SurveyMonkey survey here and complete the survey. Entrants will be required to provide the entrant’s full name, company name, valid company email address, and job title.. Upon completion of the survey, the entrant will be entered (an “Entry” and collectively, the “Entries”) into the Sweepstakes with a chance to win a prize.
5. Entry Conditions:All Entries must be received during the Entry Period to be eligible for the Sweepstakes. Any Entry received prior to or after the Entry Period will be void. Participation in the Sweepstakes is voluntary and does not require an entrant to purchase anything from Sponsor. For alternative entry: email your name, company, address, email and phone number during the Entry Period to KACEproductmgmt@quest.com for an Entry. In the event of a dispute over the identity of an online entrant, the Entry will be deemed submitted by the authorized account holder of the email address associated with the Entry. Authorized account holder is defined as the person assigned to an email address by an Internet access provider, online service provider or other organization responsible for assigned email addresses. Sponsor is not responsible for any lost, illegible, incomplete, damaged, or misdirected Entries or Entries not properly forwarded to Sponsor. LIMIT OF ONE ENTRY PER PERSON DURING THE ENTRY PERIOD. Any attempt by an entrant to submit more than one Entry by using multiple/different email addresses, identities, or any other methods will void that entrant’s Entries and that entrant will be disqualified.
6. Prizes and Approximate Retail Value (“ARV”): The following prize (“Prize”) will be awarded to nine different winners, one Prize per winner: a $500 Amazon gift card. Sponsor assumes no responsibility if the survey is cancelled, delayed, suspended, or rescheduled for any reason. The ARV of each Prize is $500 and the total ARV of all Prizes awarded in this Sweepstakes is $4500 .
7. Prize Conditions: All values listed reflect the approximate retail value in U.S. dollars. All estimated values are subject to change based on, among other things, normal price fluctuations associated with the consumer marketplace. No cash or other substitution may be made, except by Sponsor, who may substitute a Prize of equal or greater value. Potential winners are subject to verification. All federal, state and local taxes, and all other costs associated with acceptance or use of a Prize, are the sole responsibility of the winner. A winner may waive his/her/their right to receive a Prize. A Prize is non-transferable, non-exchangeable, and non-refundable, must be accepted by the winner as awarded, and will be awarded to the individual named entrant only. No substitution of Prizes will be made except as provided herein at the Sponsor’s sole discretion. LIMIT ONE PRIZE PER ENTRANT.
8. Prize Drawings: On or about December 17, 2021], nine (9)potential winners will be randomly selected (“Drawing”) from among all eligible Entries received during the Entry Period to win one Prize per winner. In the event that a potential winner is disqualified or unable to claim a Prize for any reason, Sponsor will award the applicable Prize to an alternate winner by random Drawing from among all remaining eligible Entries. Only three alternate Drawings will be held after which the Prize will remain un-awarded.
9. Winner Notification and Conditions: The potential winners will be notified by email using the contact information provided at the time of entry. Sponsor is not responsible if unable to contact a potential winner for prize notification purposes for any reason, including entrant’s failure to provide correct contact information at the time of entry. Each potential winner (parent/legal guardian if winner is a minor in his/her/their state of residence) will be required to sign and return to Sponsor, within ten days of the date notice or attempted notice is sent, an Affidavit of Eligibility, Liability and Publicity Release (except where prohibited by law) and a valid W9 form (for prizes exceeding $600 in retail value) (“Required Documentation”) in order to claim his/her/their Prize. If a potential winner cannot be contacted, fails to sign and return the Affidavit of Eligibility, Liability and Publicity Release or W9 (when applicable) within the required time period, or the winner notification is returned as undeliverable, the potential winner forfeits the Prize. Potential winners must continue to comply with the Official Rules and winning is contingent upon fulfilling all requirements. By entering, entrant agrees he/she is in compliance with all of his/her/their employers’ rules, policies, and procedures that relate to accepting prizes. Sponsor will coordinate delivery of Prizes with confirmed and verified winners within 15 days after the potential winner has completed and returned to Sponsor the Required Documentation.
10. Odds of Winning: Odds of winning the Prize depend on the number of eligible Entries received during the Entry Period.
11. Release and Indemnification: By entering, each entrant agrees to release and hold harmless Sponsor, Quest Software Inc., and its respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any and all losses, damages, right, claims or cause of action of any kind arising in whole or in part, directly or indirectly, from the Sweepstakes or participation in any Sweepstakes-related activity including, but not limited to, resulting directly or indirectly from acceptance, possession, use or misuse of any prize awarded in connection with the Sweepstakes, including without limitation, personal injury, death, or damage to or loss of property, as well as claims based on publicity rights, defamation, and invasion of privacy.
12. Publicity: Except where prohibited, participation in the Sweepstakes and acceptance of a prize constitutes winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
13. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner, in Sponsor’s sole opinion. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
14. Limitations of Liability: The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Sweepstakes; (d) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (e) late, lost, undeliverable, damaged or stolen mail; or (f) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any Prize. If for any reason an entrant's Entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another Entry in the Sweepstakes, provided that the Entry Period has not ended. If the Sweepstakes is canceled, suspended or modified, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible Entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of Prizes will be awarded. In the event that production, technical, programming or any other reasons cause more than the stated number of Prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of Prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
15. Disputes: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the state and federal courts of the State of California. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
16. Entrant's Personal Information: Information collected from entrants is subject to these Official Rules and the Sponsor’s privacy policy located at www.quest.com/privacy; provided that, in the event of any conflict between these Official Rules and the Sponsor’s privacy policy, the terms and conditions of the Official Rules will prevail. Each entrant’s participation in this Sweepstakes constitutes acknowledgement of the Sponsor’s privacy policy and consent for Sponsor, its affiliates and group companies, and its representatives to use entrant’s personal information for the purpose of administering the Sweepstakes and awarding the Prizes and distributing advertising email communications. Entrants may choose to opt-out of future email notifications by clicking the link in the email and following the opt-out instructions. Opting in to specific offers does not improve an entrant’s chances of winning.
17.
